Paperwork involved in Hazardous Waste Management can be long, tedious and at times confusing. There are a total of 12 hazardous waste regulation forms which serve different purposes.

These hazardous waste regulation forms are frequently used in various legal procedures while dealing with waste management. You can get a brief overview of hazardous waste regulations in India in our blog.

As you manage your hazardous wastes you’ll need to file these forms on a regular basis for different waste regulation purposes.Some of these forms are related to different types of hazardous waste materials mentioned under various schedules by govt. and need to be cross referenced with that.

Regulations Form 1

If you are curious this form comes under Rule 6 (1) in Hazardous and other Wastes (Management & Transboundary Movement) Rules, 2016 established by Central Pollution Control Board.

If you are involved in any of the following activities related to hazardous waste you will need to file application in Form 1 to State Pollution Control Board and get it’s authorization – 

  • Handling 
  • Generation
  • Collection
  • Storage
  • Packaging 
  • Transportation
  • Use
  • Treatment
  • Processing 
  • Recycling 
  • Recovery 
  • Pre-processing
  • Co-processing
  • Utilisation 
  • Offering for sale, transfer or disposal 

You would require following documents for this – 

  • Declaration of Consent to establish granted by the State Pollution Control Board.
  • Declaration of Consent to operate granted by the State Pollution Control Board.
  • If you are applying for renewal of authorization a self-certified compliance report in respect of effluent, emission standards and the conditions specified in the authorisation for hazardous and other waste.

If you are applying for renewal of authorisation, application needs to be sent 3 months prior to expiry of authorisation.

Your Form comprises of 3 parts – 

  • Part A – Requires to be filled by everyone.
  • Part B – To be filled by hazardous waste generators.
  • Part C – To be filled by Treatment, storage and disposal facility operators.
  • Part D – To be filled by recyclers or pre-processors or co-processors or users of hazardous or other wastes

Regulations Form 2

Form 2 is for grant or renewal of authorisation by State Pollution Control Board to the occupiers, recyclers, reprocessors, reusers, user and operators of  disposal facilities.

Once you have met all necessary requirements for appropriate facilities State Pollution Control Board will give you authorisation to carry out below mentioned hazardous waste related activities  as per Form 2 – 

  • Collection 
  • Storage 
  • Packaging 
  • Transportation 
  • Treatment 
  • Processing 
  • Use 
  • Destruction 
  • Recycling 
  • Recovery 
  • Pre-processing 
  • Co-processing 
  • Utilisation 
  • Sale, transfer or disposal 

Once you get this authorization it will be valid till 5 years unless otherwise mentioned by the State Pollution Control Board.

Regulations Form 3

This form is used for maintaining records of hazardous and other wastes

According to Rule 6(5)  Hazardous and other Wastes (Management & Transboundary Movement) Rules, 2016 If you’re an occupier or operator of hazardous waste you’ll need to maintain records in format shown in Form 3 and submit to the state pollution control board.

If you’re an importer or exporter of hazardous waste than you have to maintain records in form 3 format and keep them ready to show incase of an inspection

Regulations Form 4

If you’re one of the following you’ll be required to submit Form 4 on or before 30th of June every year by – 

  • Occupiers of a hazardous waste facility.
  • Importers of hazardous waste.
  • Operators of hazardous waste facilities.

This form contains of 3 parts – 

  • Part A – To be filled by hazardous waste generators.
  • Part B – To be filled by treatment, storage and disposal facility operators.
  • Part C – To be filled by recyclers, co-processors or other users

Regulations Form 5

Form 5 is used for applying to import or export  hazardous waste for following purposes – 

  • Reuse of hazardous waste
  • Recycling of hazardous waste
  • Recovery of hazardous waste
  • Co-processing of hazardous waste
  • Utilisation of hazardous waste

You’ll need to fill this form for – 

  • Importing or transit for transboundary movement of hazardous waste specified in Part A and Part B of Schedule III.
  • Exporting hazardous waste specified in –
    1. Part A of Schedule III
    2. Part B of Schedule III
    3. Schedule VI

Regulations Form 6

If you are transporting hazardous waste, you will need Form 6. It deals with documentation for transboundary movement of hazardous waste.

Form 6 needs to be filed if you’re – 

  • Import of hazardous waste.
  • Exporting of hazardous waste.

Regulations Form 7

Form 7 is for one time authorization of traders for Part-D of scheduled III waste listed in Hazardous and other Wastes (Management & Transboundary Movement) Rules, 2016.

You will be required to submit this form to the State Pollution Control Board.

If you’re a trader importing waste on someone else’s behalf you would require this form. 

Regulations Form 8

When you label your  hazardous waste it would need to be done as per form 8.

This is the labelling protocol you’ll need to follow to label hazardous wastes that are stored or wastes that are being transported from one place to the other.

It consists following – 

  • Mention of waste category
  • Total quantity of waste in container
  • Date of storage
  • Sender and receivers details (if under transportation)

Regulations Form 9

Form 9 is provided to the transporter of waste by occupier. It explains the nature of hazardous waste and measures to be taken in case of an emergency.

Following characteristics of waste need to be mentioned – 

  • Type of waste
  • Physical properties
  • Chemical constituents
  • Exposure Hazards
  • First Aid requirements

Regulations Form 10

You would be required to fill this form for movement of hazardous waste within the country.

Sender of the waste is required to make 7 copies of form 10 , each copy having a different colour code.Each colour code copy is sent to a different place and is signed by the sender.

Different Colour codes and their purpose – 

  1. Copy 1 (White) – To be sent to the State Pollution Control Board.
  2. Copy 2 (Yellow) – To be retained by the sender after taking the signature of the transporter.
  3. Copy 3 (Pink) – This copy is to be retained by the receiver of waste.
  4. Copy 4 (Orange) – Once the receiver has received the waste, this copy is handed over to the transporter.
  5. Copy 5 (Green) – Receiver of waste has to send this copy to the State Pollution Control Board.
  6. Copy 6 (Blue) – This copy is to be sent by the receiver to the sender of waste.
  7. Copy 7 (Grey) – In cases where the sender is in another state, the receiver has to send this copy to the State Pollution Control Board of the sender. 

Following signatures are required on different copies – 

  • Sender’s Signature – All 7 copies ie- copy 1 to copy 7.
  • Receiver’s Signature – 4 copies ie- copy 4, copy 5, copy 6, copy 7.
  • Transporters Signature – Copy 2.

Regulations Form 11

Accidents are always possible and we always need to take them. Incase of an unfortunate event of an accident  where hazardous waste is involved Form 11 needs to be filled and sent to the State Pollution Control Board.

Regulations Form 12

In case you feel an unfair order has been passed against you, you have the right to appeal against it.

Form 12 is used to submit an application against the order passed by the State Pollution Control Board.
